1. Scope

These terms govern the use of the personal website operated at marcelrgberger.com ("the Site") by Marcel R. G. Berger / Berger & Rosenstock GbR, Dieselstr. 22e, 61231 Bad Nauheim, Germany. The Site is an informational and personal-branding presence; it offers no products or paid services. For client engagements see theapparchitect.com.

2. Content and Use

All content on the Site — text, images, code samples, brand assets — is the intellectual property of the operator or its licensors and is provided for personal, non-commercial reading. Linking to the Site is permitted. Reproducing or redistributing content requires prior written consent.

The information on this Site reflects the operator's opinion at the time of writing. It is not legal, tax, financial, or technical advice. Use at your own risk.

3. Newsletter

Subscription to the newsletter is voluntary, free of charge, and requires explicit double opt-in confirmation. You can unsubscribe at any time via the link in every email or by emailing hello@marcelrgberger.com. The operator may discontinue the newsletter or change its content at any time without notice.

4. External Links

The Site contains links to third-party websites (App Store, GitHub, LinkedIn, Amazon, etc.). The operator has no control over the content of these external sites and accepts no responsibility for them. Linked sites were reviewed at the time of linking; no illegal content was apparent.

5. Availability

The Site is offered "as is" and "as available". The operator does not guarantee uninterrupted availability, error-free operation, or fitness for any specific purpose. Scheduled maintenance, hosting changes, or third-party outages (e.g. GitHub Pages, MailerLite, Apple App Store, GitHub API) may affect availability or the display of dynamic data (apps, ratings, GitHub activity).

6. Liability

To the extent permitted by law, the operator is liable only for damages caused by intent or gross negligence. Liability for slight negligence is limited to the breach of essential contractual obligations and the foreseeable damage typical for the relevant agreement. Liability under the German Product Liability Act (Produkthaftungsgesetz) and for injury to life, body, or health remains unaffected.

7. Data Protection

Personal data is processed in accordance with the privacy policy, which forms part of these terms.

8. Changes

The operator may update these terms when content, processing, or applicable law changes. The current version is always available on this page.

9. Governing Law and Jurisdiction

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you act as a consumer, mandatory consumer-protection provisions of the country in which you have your habitual residence remain unaffected. For disputes with merchants, legal entities under public law, or special funds under public law, the exclusive place of jurisdiction is Friedberg (Hessen), Germany.

10. Severability

If any provision of these terms is or becomes invalid, the validity of the remaining provisions is not affected.
